在之前的文章中,我们介绍过在澳洲办理离婚的要求与流程。文章中提到申请离婚的其中一个要求是分居要求——在申请离婚之前,你和你的配偶必须已分居至少12个月。但是现实中可能会有这种情况——夫妻双方已经分居,却生活在同一个屋檐下(separation under one roof)。这样满足离婚的分居要求吗?
同一屋檐下的分居(Separation under one roof)
如果一对夫妻分居,但由于经济、抚养子女或其他原因继续住在同一所房子里,这被称为 “在同一屋檐下分居”。这可能是分居后的几天、几周、几个月或几年。 根据Family Law Act 1975 (Cth) section 49规定,尽管婚姻双方继续居住在同一住所,或任何一方为另一方提供了一些家庭服务,但可以认定他们已经分居。 如果夫妻双方在规定的12个月分居期的部分或全部时间里住在同一个家里,也是可能满足分居要求的,但是必须在申请离婚时向法院提供额外的证据来证明你们满足了分居要求——必须在提交离婚申请时向法院提交一份宣誓书(affidavit)。
