What are the threshold requirements for commencing proceedings in Australia?

In Australia, simply having a dispute does not automatically entitle you to bring court proceedings. To commence litigation, you must satisfy certain threshold requirements. In general, you must have a cause of action, which can arise under statute or case law.

How do you prepare originating court documents (a statement of claim) in Australia?

To commence proceedings, the plaintiff must first file a Complaint and Statement of Claim with the court. This document should set out the essential background of the case, the legal basis for the claim, and the amount and method of damages or other relief the plaintiff seeks.

If you are the defendant, how should you prepare your response?

Once served with a copy of the plaintiff’s originating process, the defendant must respond to the plaintiff’s claims within the time prescribed by the rules of the relevant court. Filing deadlines vary between courts. For example, in the County Court of Victoria a defendant must file a Notice of Appearance within 10 days of being served with the statement of claim, and a Defence within the following 30 days. In the Defence, the defendant is entitled to set out any matters that answer or dispute the plaintiff’s claims.
